The master agreement governing your use of the LeasedTourz platform.
By accessing or using LeasedTourz (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and DivaddLimited ("LeasedTourz," "we," or "us").
LeasedTourz provides an on-demand property touring platform that connects property management companies, real estate agents, and enterprise clients with vetted LeasedTourz Property Tour Professionals ("Guides"). You may use the Platform solely for lawful business purposes related to scheduling, conducting, and managing property tours.
You must be at least eighteen (18) years of age and have the legal authority to enter into binding agreements to use the Platform. By registering an account, you represent and warrant that you meet these eligibility requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach. We reserve the right to suspend or terminate accounts that violate these Terms.
Certain features of the Platform require a paid subscription. Subscription plans, pricing, included tour volumes, and overage rates are described on our Pricing page and in the Subscription Agreement. Subscriptions auto-renew at the end of each billing cycle unless cancelled in accordance with the Cancellation Policy.
Clients may submit tour requests through the Platform subject to guide availability and scheduling constraints. LeasedTourz uses its AutoTour™ intelligent dispatch system to match tours with qualified Guides based on location, availability, language requirements, and certification status. We do not guarantee that every tour request will be fulfilled.
Tours are considered complete when a Guide arrives at the designated property and conducts the tour in accordance with the Tour Standards Policy. If a tour cannot be completed due to access issues, property unavailability, or prospect no-show, the applicable policies in the Cancellation Policy and Refund Policy will govern.
LeasedTourz is a scheduling and dispatch platform. We do not own, manage, or control any property listed on the Platform. We are not a real estate brokerage and do not facilitate lease negotiations or binding agreements between prospects and property owners. Guides are independent contractors, not employees of LeasedTourz.
Clients are responsible for providing accurate property information, ensuring property access is available at the scheduled tour time, and maintaining safe conditions at tour locations. Clients must have the legal authority to authorize tours and grant property access as described in the Property Access Agreement.
Guides are responsible for arriving on time, conducting professional tours, adhering to the Tour Standards Policy and Guide Code of Conduct, and submitting post-tour reports. Guides must maintain their own schedule availability and notify the Platform of any changes that affect their ability to fulfill assigned tours.
Clients are billed for tours and subscriptions according to the Billing Policy. Guides receive compensation as independent contractors as described in the Independent Contractor Agreement. LeasedTourz facilitates payments through the Platform but is not responsible for payment disputes between parties except as provided in these Terms.
Cancellations are governed by the Cancellation Policy, which establishes timeframes, penalties, and rescheduling procedures for both client-initiated and guide-initiated cancellations. Late cancellations and no-shows may be billed at the full tour rate.
The LeasedTourz name, logo, software, AutoTour™ technology, training materials, and all Platform content are owned by DivaddLimited and protected by intellectual property laws. You may not copy, modify, or distribute Platform content without our written consent. See the Intellectual Property Policy for details.
The Platform is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or that tour requests will always be fulfilled. Guides are independent contractors, and we do not guarantee their performance.
To the maximum extent permitted by law, LeasedTourz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total aggregate liability shall not exceed the amounts you paid to us in the three (3) months preceding the claim.
Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the Dispute Resolution Policy. The governing law shall be the laws of the State in which LeasedTourz is incorporated, without regard to conflict of law principles.
We reserve the right to suspend or terminate your account at any time for violations of these Terms, the Acceptable Use Policy, or any applicable law. Upon termination, all outstanding obligations remain due. See the Account Suspension section of the Acceptable Use Policy for details.
We may update these Terms from time to time. Material changes will be communicated via email or Platform notification. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
